What NOT to do when hiring a Promoter or JV Broker

It is a lesson I wish I never had to learn, but with success there is always a certain amount of failure.
In our case, we hired a JV Broker to promote our new membership site. He promised us the moon, he overdelivered, the membership was oversold, we were too successful if you can believe that. And now he wants to destroy it.
What we did wrong:
Allowed the promoter to take control of the membership by using a new domain that he registered instead of the one we had in operation for nearly a year.
He led everyone to believe that he had invented this incredible technology, taking credit away from us and all the hard work we put in for over a year to develop this technology.
He misled people with his highly converting sales pitch - yes it converted up to 9% for some affiliates and worse yet, it refunded at 30% because of misinformation in the sales letter.
We were forced to allow the promoter to handle all the money through substandard online merchant accounts that have all been frozen so we don; tknow hen there will ever be any money for the affiliates or us.
Now that he has his panties in a wad, he has threatened to kill the membership at the end of the month and pull the domain out from under us.
The list goes on but you get the picture.
Of course we control the product so we won’t lose out there, but the members who have been put through hell already by being plagued with declined credit card transactions, refunds that never happened, and now to get them to move to a new domain and resubmit their payment to a new gateway is not a good way to build a relationship.
We are now faced with affiliates wanting to get paid, of course we want to get paid too! We want to keep our membership and we want the members to be happy. We have no money, we soon will have no domain but we have our members who hopefully will stick with us and understand the circumstances beyond our control.
We are three honest and forthright guys wanting to provide a unique product and service, and we have literally been screwed by an egomaniac. The only good part about it is he plastered HIS name all over the project so when there is a gripe b a member or affilaite, at least they will be after him and not us.
